Defendants in error began this action in the district court of Craig county, on September 23, 3911, seeking partition of the lands described in their petition. The plaintiffs in error, who will hereafter be referred to as defendants, filed their second amended answer to said petition; and on July 22, 1912, the court sustained a demurrer to said second amended answer, and defendant Addie Chouteau excepted to the ruling of the court upon said demiurrer, elected to stand upon her answer, and declined to plead further.
