Background
This case is a primer on why lawyers should not do business with their clients. Defendant Franklin K. Lane III (Lane) represented plaintiff Jack N. Younesi (Younesi) in various business matters and related litigation. Later, Younesi suffered financial reverses and convinced Lane to loan him $82,500, much of which Lane borrowed from banks. The loan was secured by a trust deed on Younesi’s house, some worthless stock, and undelivered personal property.
