This case presents error from the district court of Lincoln county. Defendant in error, who will hereafter be denominated “plaintiff”, filed her action against H. S. Emmer-son, as administrator of the estate of Joseph D. Morris, deceased, to recover on two causes of action, in the first of which she alleges that Joseph D.
