This case comes before us on the ruling of the district court of Wilson county, sustaining a demurrer to plaintiff's petition. The petition alleges, substantially, that plaintiff owned a farm in Chautauqua county of the value of $5,000; that for the purpose of procuring a loan from the de*485fendant Stover, plaintiff executed his promissory note payable to the order of Stover in five years, for the sum of $2,000, and also for the purpose of securing said note, executed a mortgage on his farm; that he delivered the note and mortgage to Confrey,…
