Plaintiff is serving a life sentence for a murder committed in 1987. He appeals the dismissal of his petition for a writ of habeas corpus, arguing that the trial court erred in granting defendant’s motion to dismiss based on its finding that a psychological report provided sufficient support for the Board of Parole and Post-Prison Supervision’s (Board) conclusion that plaintiff suffers from a present severe emotional disturbance such as to constitute a danger to the health or safety of the community, and that the Board therefore properly deferred plaintiffs parole release date from 1996…
