On October 21, 1913, the following promissory note,purporting to have been made by the appellant, James ■W. Finley, was executed and delivered to the Madison-ville Savings Bank:
“Four months after date, for value received, the undersigned promises to pay to the order of Madisonville Savings Bank, Madisonville, Kentucky, Two Thousand Five Hundred Dollars, without defalcation, negotiable and payable at the banking house of said bank in Madisonville, Kentucky.
