This case involves certain disturbing questions growing out of alleged misconduct on the part of the membership of a court-martial. The present accused, Smith, pleaded not guilty to, but —following trial by a general court— was convicted of, involuntary manslaughter, wrongful appropriation of a motor vehicle, and fleeing the scene of an accident, in violation respectively of Articles 119, 121 and 134, Uniform Code of Military Justice, 50 USC §§ 713, 715 and 728.
