Petitioner Carter is a defendant in an action pending in the superior court of Kern County, in which one Mary Y. Douthit, a resident of the state of Oregon at and ever since the commencement of the action, is the plaintiff. He regularly made demand as provided by sections 1036 and 1037 of the Code of Civil Procedure, for security for the costs and charges which might be awarded against the' plaintiff in the action.
