This action arises out of a trust agreement executed by Arthur P. Pollard May 6, 1954, a few days before his second marriage. It provided that income of the trust estate, plus payments from principal which the trustees were permitted to make, should go to Pollard for his life. Upon his death the trust was to terminate, and its assets to be distributed to the four adult children of Pollard by his predeceased wife.
