Phillip Johnson raises four issues on appeal: (1) whether the trial court abused its discretion when it denied Johnson’s motion to strike Juror #464 for cause, and, later, denied Johnson’s motion for a mistrial when the juror became a deliberating juror under circumstances in which Juror # 464 had indicated that she had a close relationship with a friend who, in turn, was close to relatives of the victim present in the courtroom, and the juror demonstrated an inability to objectively evaluate the evidence; 1 (2) whether the trial court erroneously instructed the jury…
