On July 9, 1954, the accused unlawfully departed from his unit at the U. S. Naval Training Station, Great Lakes, Illinois. Over four years later, on August 1, 1958, he was apprehended and delivered to the Naval Air Station at Memphis, Tennessee, where he was subsequently tried by general court-martial for desertion, in violation of Article 85, Uniform Code of Military Justice, 10 USC § 885.
