NEEDHAM, J., pro term.

This is an appeal taken by the plaintiff from a judgment of nonsuit entered in favor of the defendant, and the appeal is before us upon a bill of exceptions. The material facts are as follows: The action is brought by the plaintiff to recover from the defendant the value of certain alleged personal property claimed to have been converted by the defendant to its own use, and also for compensation for the use of said property by the defendant.
