MAHONEY, Circuit Judge.

The Securities and Exchange Commission, hereinafter called S.E.C., brought this action to enjoin the officers and trustees of Aldred Investment Trust from continuing to act in such capacities and for the appointment of receivers. The District Court held that all but one of the individual defendants1 had been guilty of “gross abuse of trust” as officers and trustees of the trust within the meaning of § 36 of the Investment Company Act of 1940, 54 Stat. 841, 15 U.S.C.A. § 80a — 35. 58 F.
