Presently pending in this civil action is defendant’s motion seeking summary judgment on all five counts of the complaint. Defendant has filed a memorandum and various exhibits in support of her motion for summary judgment. Plaintiffs have opposed the motion, but have not submitted a memorandum of law. Rather, plaintiffs have relied in their opposition to the motion on excerpts from depositions taken in this case. Oral argument has been heard in open court.
