This is an appeal from an order denying plaintiff’s motion for a new trial.

The litigation arises out of a dispute concerning commissions which plaintiff claims to have earned while employed by defendant.

Up to April 1956, Nash Finch Company owned and operated St. Cloud Restaurant Supply Company, which was engaged in selling and installing restaurant fixtures and equipment. Plaintiff was an employee of Nash Finch Company.
