Plaintiff sued for damages on a complaint containing four counts. The first was for assault and bat*612tery, the second for false imprisonment, and the third and fourth for malicious prosecution. The litigation grew out of an altercation which took place in the San Francisco offices of the defendant insurance company between plaintiff and three of the company’s employees, named Russell George, G. L. and J. A. Smith, over the possession of a check which had been handed to plaintiff by George in settlement of accident insurance, and which plaintiff attempted to take away with him, so defendants…
