Plaintiffs, who are husband and wife, brought this action to recover damages alleged to have been inflicted upon them by defendant through a physical assault. The latter filed a cross-complaint containing several causes of action, and the jury brought in a verdict in favor of the cross-complainant for damages in the sum of $12, arising out of the breaking of a window in the door of his automobile, and also allowing him damages in the sum of $2,870 on a cause of action based upon malicious prosecution.
