This is an appeal from a judgment in favor of plaintiff for damages for alleged malicious prosecution resulting from his arrest under two criminal complaints which were sworn to by J. D. Weatherly, an employee of the Peoples Finance & Thrift Company of Riverside.
The amended complaint contains two causes of action. The first is based on a complaint sworn to before the Justice of the Peace of Mecca Township in Riverside County in which plaintiff was charged with violating the provisions of section 417 of the Penal Code.
