This action was instituted in the city court of Muskogee by plaintiff in error, as plaintiff, against the defendant in error, as defendant, to recover $225 on a contract. Judgment was rendered in the city court in favor o.f the plaintiff, and the defendant appealed to the superior court ,of Muskogee county, Okla. When the case was called for trial in the superior court, a jury was duly impaneled and.sworn to try the cause.
