STEPHENS, Circuit Judge.
Appellant, Hedda Hopper, filed, in the Superior Court of the State of California, a complaint for damages upon four alleged causes for breaches of an oral contract. The case was removed to the District Court of the United States because of diversity of citizenship. In the District Court separate motions of defendant-appellees to dismiss the complaint and each count thereof were made, and the motions to dismiss the first, second and fourth causes of action were granted.
