Dear Governor Riley:

We have received your letter requesting an advisory opinion as to whether the swap agreements House Bill 817 authorizes the State and certain Authorities1 to enter *376into would violate state constitutional provisions prohibiting the creation of new debt by the State. Section 12-2-10, Ala. Code 1975, authorizes the governor to request an advisory opinion from this Court.
