MEMORANDUM OF DECISION

Introduction
On January 12, 2008, Debtor Clifford Pegram (“Debtor”) filed a petition for relief under chapter 7 1 of the Bankruptcy Code. In connection with that case, the chapter 7 trustee, Jeremy J. Gugino (“Trustee”), commenced this adversary proceeding on March 11, 2008, to recover a 2006 Polaris ATV from Defendant James Knezevieh (“Defendant”), alleging that the ATV was property of Debtor’s bankruptcy estate.
