Introduction

Plaintiff Jeremy Gugino (“Trustee”), trustee in the chapter 7 bankruptcy case of James D. Pierce (“Pierce”), has moved for entry of a summary judgment in this adversary proceeding which he is prosecuting against Defendant Miranda M. Ortega (“Ortega”). In this action, and through his motion, Trustee seeks to avoid Pierce’s alleged fraudulent transfer of his interest in a boat made to Ortega pursuant to § 548(a)(1)(B). 1 Because the Court concludes there remains a question of material fact regarding the value of the interest…
