FRANKEL, District Judge.
The one-count indictment in this case says:
“On or about the 11th day of March, 1969, in the Southern District of New York, JOSEPH MICHAEL AGONE, a/k/a/ ‘Joe Curly’, the defendant, unlawfully, wilfully and knowingly, did through the use of force and violence and the threat of the use of force and violence, restrain, coerce, intimidate, and attempt to restrain, coerce and intimidate a member of a labor organization engaged in an industry affecting commerce, to wit, a member of Local 11, Chain Service Restaurant, Luncheonette and Soda Fountain Employees Union,…
