This is the third time the present litigation has engaged the attention of this court. Instituted in January of 1958, the action sought an injunction and damages as a result of defendants’ assertedly unfair solicitation of plaintiff’s former customers, and unfair competition generally. After granting a permanent injunction and awarding damages, the trial court subsequently exercised its powers under section 662, Code of Civil Procedure, and reopened the case on the sole issue of the amount of damages; defendants thereupon appealed from that portion of the judgment granting injunctive relief…
