This back pay case is before the court on cross motions for summary judgment. Both parties submit there is no *244genuine issue as to any material fact and both contend they are entitled to have summary judgment granted in their favor. After a careful review of the briefs and oral arguments presented, we grant defendant’s motion for summary judgment for the reasons hereinafter stated.
