The employee, a filling carrier employed by a cloth manufacturer, suffered a fractured arm by hitting with his hand a tangled belt on a machine operated by a fellow employee. In the Superior Court a decree was entered declaring that the injury arose out of and in the course of his employment and that the injury was not caused by the serious and wilful misconduct of the employee, and ordering the payment of compensation. The insurer appealed.
