AMUNDSON, Justice.
Lynne Delano and the State of South Dakota appeal the trial court’s grant of Willard G. Petteys’ motion for summary judgment in a declaratory judgment action. We affirm.
FACTS
Willard G. Petteys (Petteys) was convicted of sexual contact with a child under sixteen years of age on March 27,1987. As a factual basis for his guilty plea, Petteys admitted that he performed an act of oral sex upon a nine-year-old boy.
