In this case the Enid Springs Sanitarium & Hospital, defendant in error, as plaintiff, brought an action against the board of county commissioners of Garfield county, plaintiff in error, as defendant. The parties will be referred to as they appeared in the trial court. The plaintiff is a corporation and uwns and operates a hospital in the city of Enid, Garfield county, Dr. T. B.
