This was an action in declaratory relief brought by plaintiff against the defendant for the purpose of having the court make its written declaration concerning the controversy between the parties regarding the fact as to whether or not a certain parcel of land described in the complaint was. subject to the provisions of a contract entered into between plaintiff’s assignors and defendant on February 1, 1936.
