Plaintiffs brought this action against the Sweeny Investment Company, a corporation, F. J. Finucane and Charles C. Finucane, president and secretary, respectively, of the company, to recover damages in the sum of one hundred thousand dollars. The complaint is apparently based upon two theories — one for a breach of an oral contract; the other for deceit, based upon fraudulent representations made to plaintiffs, to induce them to enter into the contract.
