— On November 19,1915, tbe respondent Marie Kritzer and tbe defendant Otto Reinig, respectively tbe administratrix and administrator witb tbe will annexed of tbe estate of Joe Kritzer, deceased, borrowed from tbe appellant, A. J. Moffat, tbe sum of fifteen hundred dollars, mortgaging to secure the loan certain real property belonging to the estate. No part of the mortgage indebtedness, except the sum of twenty dollars was paid; and on February 19, 1919, the mortgagee instituted a suit to foreclose the mortgage.
