OPINION AND ORDER
OWEN, District Judge.
Plaintiffs and defendants each move for summary judgment against plaintiff-interve-nor Jeffrey Sado. 1 Summary judgment is appropriate when there is no genuine issue of material fact, and the moving party is entitled to judgment as a matter of law. Fed. R.Civ.P. 56(c).
