In 1995, trustees for the Tile Layers & Tile Finishers B.A.C. Local Union 32 (“Trustees”) filed a civil ERISA action, pursuant to 29 U.S.C. §§ 1132 and 1145, against Fantin Enterprises, Inc. (“Fantin”), to obtain an accounting of the corporation’s records and to collect any delinquent fringe benefit contributions owed by Fantin.
