I. INTRODUCTION

This ERISA fringe benefits contribution action is presently before the Court on the parties’ cross-motions for summary judgment which were filed while this case was pending before the Honorable Robert De-Mascio. Each of the parties has responded and replied to the opposing party’s motion.
