The plaintiff, Harry Bavitch, commenced this action nearly ten years ago. In Ms complaint Bavitch alleged that on March 5, 1963, he and the defendant Hyman Stollman entered into a written contract pursuant to which Raviteh had quitclaimed his interest in substantial parcels of realty located in Durham, Middletown and East Hampton. The plaintiff, who claimed that he was previously the owner of these parcels, alleged that the defendant Stollman had acquired title to said properties either in his own name or in the name of the Stollman Poultry Farms, Ine., a corporation of which the defendant…
