This is a quo warranto proceeding to test the right of respondent to act as a special judge in the municipal court of West St. Paul pursuant to designation under M. S. A. 488.06, subd. 5.

The facts are not in dispute. The city of West St. Paul has a municipal judge but no special municipal judge. An action was started in the municipal court of West St. Paul against relator who filed an affidavit of prejudice against the municipal judge.
