Porter, J.:

John F. Linker sued to recover for personal injuries. The jury returned a verdict in his favor for $500, and made a number of special findings. This was on May 29, 1908. On the same day the defendant filed a motion for judgment on the special findings, notwithstanding the verdict; and also a motion for a new trial, setting up the statutory grounds. The motion for judgment on the special findings was sustained and the court rendered judgment in defendant’s favor for costs. Plaintiff appealed and this court reversed and remanded the cause with…
