Benson, J.:

J.John F. Linker sued for damages resulting from injuries to his person, suffered while preparing a car standing upon a sidetrack for the reception of grain. He alleged that the injuries were caused by the negligence of the defendant in carelessly pushing another car against the one in which he was at work. The answer contained a general denial, and an averment of contributory negligence. A verdict was returned for the plaintiff, but upon the special findings a *582judgment was rendered for the defendant, from which the plaintiff appeals.
