This matter came on for hearing upon plaintiff’s motion for a new trial, a verdict having heretofore been returned for the defendant, and a motion to vacate said verdict and for a new trial having been filed within three days thereafter. The case was tried before Judge Scott Stahl and a jury, but Judge Stahl died before passing upon the motion for a new trial. The motion contains the usual statutory grounds including allegations that the verdict was not sustained by sufficient evidence and was against the weight thereof, that the verdict was contrary to law, that…
