This was a re-plevin action originally instituted on the 27th day of June, 1922, in the justice court, city of Okmulgee, Okla., by the defendant in error, plaintiff below, as assignee of the chattel mortgage, for the recovery of an automobile. The mortgagor having made default ini the payment of the) notes secured by the chattel mortgage, the defendant in error, as the assignee of the mortgagee, brought his action to recover possession of said automobile.
