This action was brought by the plaintiff, J. W. Gardner, against the defendant, School District No. 87 of Kay County, to recover on a number of coupons attached to bonds issued by the school district, the payment of which had been refused. The case was tried on an agreed statement of facts, the substance of which is that these bonds were issued by the district pursuant to an election held in 1903, and under article 2, c. 7, Sess. Laws 1895; that at the time the outstanding indebtedness of the district consisted of unpaid legal warrants in the aggregate sum of $3,000; that…
