At the inception of the transactions out of which this litigation arose, John Closner, Wm. F. Sprague, the Valley Reservoir & Canal Company, and the Edin-burg (Chapin) Town-Site Company owned separate tracts which together comprised a large body of land in Hidalgo county, including the tracts here involved. The Valley Reservoir & Canal Company was a public service irrigation corporation purporting to operate adjacent to and upon the land mentioned.
