Plaintiff brought this suit against the defendants, National Casualty Company and Charles S. Eaton, for damages. For brevity the casualty company will hereafter be referred to as the company and defendant Eaton as defendant. Plaintiff alleged three causes of action in his complaint: First, for false imprisonment; second, for malicious prosecution; third, for abuse of process.
