Thomas J. Weaver, the Clerk and Master of the Chancery Court of Davidson County, Tennessee, on November 18, 1899, brought this suit in equity in that Court against the said county, in which he set forth a substantial cause of action and claim in equity, not*318withstanding there appears on the statutes of the State Chapter 124 of the Acts, generally known as the Estes Fee Bill.

The county of Davidson duly appeared by a written motion to dismiss the bill of complaint— first, because the bill did not make such a case as gives the Court jurisdiction to hear and determine the…
