This was an action for damages for injuries to the person and an automobile of the plaintiff below, C. D. Loveless. In this opinion the parties will be referred to as they stood as plaintiff and defendant in the trial court. The injuries resulted from a collision between the two automobiles of the parties on February 17, .1923, on the highway about seven miles north of Columbia, Tennessee.
