The plaintiffs in error stand convicted of the crime of murder in the second degree, of one Cam Simmons. They are the sons of Mrs. Mary Irvine, who was indicted with them, as an accessory before the fact, but who was acquitted.

*135Tbe record discloses that after an angry meeting with the deceased in the town of Carter’s Creek, on the border of which was the Simmons residence, Mrs. Irvine returned to her home, and repeated to her son, Warren, that the deceased had greatly outraged her feelings, both by his manner and in his speech.
