Plaintiff, Gold Line Refining, Ltd. (“Gold Line”) seeks damages resulting from the use of a certain economic price adjustment (EPA) clause in its contract to supply jet fuel to the United States of America, acting through the Defense Fuel Supply Center (“DFSC” or the “government”).1 The parties have filed cross-motions for summary judgment. The National Petrochemical & Refiners Association has filed amicus curiae briefing.
