Plaintiff, Omnipoint Communications, Inc., brings this action against the defendants, Planning & Zoning Commission of the Town of Wallingford (“Commission”) and the Town of Wallingford, alleging violations of the Telecommunications Act of 1996, arising out of the denial of the plaintiffs application to erect a wireless communications tower.
