This case was tried to a jury in the district court of Tulsa county. It was a suit for damages for personal injuries sustained in an automobile accident. Andrew Alexander was plaintiff in the trial court against his brother, Ferguson Alexander, defendant, in the trial court. The accident occurred on the night of December 18, 1934, on the paved highway between Tulsa and Bartlesville. It was a stormy, wintry night with snow blowing and collecting on the windshield.
